International Longshoremen’s Association South Atlantic and Gulf Coast District Privacy Policy Governing ILA Longshoremen’s Association Mobile App

This privacy policy governs the use and storage of data that is collected through your use of the ILA Longshoremen’s Association software application (the “Application”) on your mobile device or other hardware. The Application is provided by the International Longshoremen’s Association, South Atlantic and Gulf Coast District (“ILA”) and allows you to access maritime news and events, keep track of job-related certifications, and receive other relevant information via your mobile device. In addition, if your paycheck is processed by a participating payroll services provider, you can view certain employment-related information.

What information does the Application collect and how is it used?

1. User Provided Information

As described in more detail below, the Application collects the information you provide when you download the Application, create an account to access the Application, log in to the use Application, or use any of the functions within the Application (collectively, “User Provided Information”).

You must create an account in order to use the Application. When you create an account with us or login and use the Application, you may choose to provide us with the following information:

(a) your name, phone number, mailing address, and email address; the last four (4) digits of your social security number; which local chapter or affiliate you belong to; and password and other information you provide in the course of creating an account to use the Application and logging in to use the Application;
(b) information you submit to us when using the Application, such as contact information and information about your job-related certifications and their expiration dates; and
(c) information you provide us when you contact us for help, support, or other reasons.

2. Automatically Collected Information

Certain information may also be collected automatically when you use the Application, including mobile device state information, unique mobile device identifiers, device hardware and operating system information, information relating to how the Application functions, and the type of mobile internet browsers you use (collectively, “Automatically Collected Information”). Automatically Collected Information only includes information about how you use the Application. We do not collect any location information from your mobile device when you use the Application. The only location information collected by us is the contact and other User Provided Information you choose to submit.

Does this Privacy Policy apply to Payroll Information?

If you receive a paycheck from a participating payroll services provider, that provider may use the Application to provide you with information about your employment status, such as year-to-date contract hours you have worked, your MILA healthcare status, and your current certifications (collectively, “Payroll Information”).

This Privacy Policy only applies to Payroll Information as it is stored in the Application database. Participating payroll services providers are solely responsible for obtaining your consent with respect to collecting and disclosing your information for use in connection with the Application. This Privacy Policy does not apply to the collection or disclosure of your Payroll Information by your employer or the participating payroll services provider for purposes of making it available through the Application. This Privacy Policy does not apply to or address how your employer or the participating payroll services provider collects your information from you, how they may use that information, or how they obtain your consent or authorization to disclose that information. Those questions should be addressed to your employer and/or the payroll services provider, and their privacy and other policies.

How does ILA use your information?

We use User Provided Information to authenticate your account and authorize your access to the Application. If we become aware of an error in your profile information that would affect your ability to use certain features or functions of the Application, we may contact you directly using the User Provided Information to notify you and assist you in resolving the error. We may use User Provided Information to contact you or provide push notifications on your mobile device regarding expiring certifications and other time-sensitive information provided by the Application. When you first access the Application, you will be asked whether you want to accept push notifications from the Application. If you wish to change your initial choice regarding push notifications, you can do so via the settings of your mobile device.

Is your information shared with third parties?

No, except in the limited circumstances described below, we do not share information collected from the Application with any third parties.

In rare instances, we may disclose your User Provided Information if disclosure is required in order to protect our rights, protect your safety or the safety of others, investigate fraud, or to respond to a government request.

We make a limited disclosure of information to our third party services provider, who works on our behalf to provide services such as hosting, technical support, and maintenance, in order to make the Application available. Any such disclosure is incidental to those services, and the service provider does not have independent use of the information we disclose.

Links to Third-Party Websites

We may provide you with a link to a website we feel you may find of interest, such as a website where you can purchase ILA gear or access maritime news stories. If you follow the link and visit the third party website through your internet browser, you do so at your sole risk. Information you provide through any such third party website is not collected by us or monitored in any way by us. You should refer to the website’s privacy policy to understand how your information will be handled.

Analytics

We use Crashlytics, an industry-standard analytic application provided by Mobisoft Infotech, LLC to provide us with Application usage information in order to improve the functioning and stability of the Application. What are my opt-out rights?

You can stop all collection of information by the Application easily by uninstalling the Application. You should use the standard uninstall processes that is available for your particular mobile device. You can also request to delete your user account by emailing support@iladistrict.com. After receiving your request, we will promptly delete all User Provided Information in our possession except to the extent that information is incorporated into a data backup made by us (or on our behalf). Any such data backups will be deleted in the course of normal business operations, but we cannot guarantee any time frame.

Does the Application collect precise location information of the device?

The Application does not collect precise information about the location of your mobile device.

Children

Children under the age of 13 are prohibited from using the Application and ILA does not knowingly collect any information from or related to children under 13. If you become aware that your child has provided us with information without your consent, you should contact us promptly at support@iladistrict.com. We will delete such information within a reasonable time.

Data Security

We are concerned about safeguarding the confidentiality of your information. Amazon Web Services has been engaged to provide physical, electronic, and procedural safeguards to protect information collected through the Application and maintained by ILA. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Territorial Use Restrictions and Data Location

Use of the Application outside of the United States, Canada, and/or Mexico is prohibited.

Your data is collected, stored, and processed in the United States. If you reside outside the United States, your information will be transferred, processed, and stored in the United States under United States privacy standards.

Changes

As we continue to develop the Application and provide new functionality, this privacy policy may change from time to time. We encourage you to review this policy frequently in order to understand our current privacy policy.

Your Consent

By using the Application, you are consenting to ILA’s access to and processing of your information as set forth in this privacy policy now and as may be amended by us in the future. You acknowledge and agree that your consent applies to any information collected through the Application in the past or that may be collected in the future.

“Processing,” means touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States.

Release Regarding Payroll Information

It is your payroll services provider’s responsibility to obtain your consent to share your Payroll Information, including personally identifying information, with ILA and to make such information accessible to you through the Application.

Your payroll services provider is solely responsible for information they provide for use with the Application without your consent, and ILA shall have no liability arising from or related to possessing or processing that information or making it available to you through the Application.

To the maximum extent permitted by law, you hereby waive, release, and forever discharge ILA and its agents, employees, and officers, from and against any and all liabilities, damages, claims, demands, penalties, actions, costs, and expenses, including reasonable legal fees, of any kind and nature arising from or related to ILA’s possession, use, or processing of information provided by a third party to ILA at any time, including without limitation the unauthorized access to or use of such information.
